Learned counsel for the petitioner submitted that, against the impugned Judgment and Order dated 31st August 2017 passed in Regular Civil Suit No. 1469 of 2012, a substantive First Appeal is maintainable. However, due to inadvertence present Writ Petition is filed by the petitioner/original plaintiff No.3. She therefore, seeks leave to withdraw the present Petition with liberty to file a substantive Appeal as may be permissible under the law.

Leave and liberty granted.
