By this petition the petitioner seeks to register an offence against the respondent no.2 on the basis of complaint dated 7th August, 2014.

The grievance of the petitioner is that the respondent no.2 has performed black magic on him, and as a result he is facing physical ailments such as pain in legs, headache, trembling of hands, legs and the whole body. The petitioner has stated that the acts of the

respondent no.2 are in violation of the provisions of the Maharashtra Prevention and Eradication of Human Sacrifice and Other Inhuman, Evil and Aghori Practices and Black Magic Ordinance, 2013. 3.

The learned APP has submitted that the petitioner has filed similar petitions with similar grievances and upon enquiries, it is revealed that there is no merit in the allegations made by the petitioner. Learned APP has placed on record copy of letter dated 19th March, 2015 addressed to him by the Senior Police Officer of Pant Nagar Police Station, Mumbai.

We have heard the petitioner in person and learned APP Mrs. Kejriwal for the State.

A perusal of the letter dated 19th March, 2015 addressed by the Senior Police Inspector to the learned APP reveals that though the petitioner has been filing similar petitions since the year 2009 and that the same were enquired into, no cognizable offence was disclosed. The petitioner has also placed on record copy of the order dated 23rd July 2014, passed by the Division Bench of this Court in Criminal Application No. 611 of 2014. A perusal of the said order also reveals that the petitioner had filed a petition with similar

grievance and by order dated 23rd July, 2014 the petitioner was directed to approach the Senior Inspector of Police of Pant Nagar Police Station and file a written complaint. The Senior Inspector of Police, Pant Nagar Police Station was directed to take action in accordance with law.

Since the petitioner has already filed similar applications, and directions were already given to the concerned police officer to look into the grievance of the petitioner herein, we do not find it appropriate to pass any further orders in this matter.
