Applicant has been convicted and sentenced under Section 302 of the Indian Penal Code. Being aggrieved, the applicant filed Criminal Appeal No.1189 of 2006 before this Court. This application has been preferred by the applicant through jail.

In this application, the applicant has

APPA 151-15.odt stated that earlier he had engaged Advocate Zia Ul Mustafa who had filed the Appeal i.e.1189 of 2006. However, as Advocate Zia Ul Mustafa has remained absent, the hearing of his Appeal could not proceed, hence, he has prayed that NOC be taken from Zia Ul Mustafa and instead Yug Mohit Chaudhary be appointed to conduct his Appeal.

Advocate Ms Talat Zehra h/f. Advocate Yug Mohit Chaudhary has stated that Vakalatnama was filed by Zia Ul Mustafa and M.H.Banderkar. They have obtained NOC from the concerned Advocate and after obtaining NOC, Advocate Yug Mohit Chaudhary has filed his Vakalatnama in the appeal.

In view of the above, nothing survives in this application and the same is disposed of as infructuous.
