Having taken instructions from the Petitioner's son who is present in the Court, learned Counsel appearing for the Petitioner seeks leave to withdraw the writ petition with liberty to file an application before the trial Court for framing of charge for the offence punishable under section 302 of the Indian Penal Code, 1860 on the basis of material on record. Leave with liberty as prayed for is granted. Petition is allowed to be withdrawn and is disposed of as such.

In the event such an application is made by the Petitioner, trial Court shall decide the same independently on its own merits.
