The petition is filed for transfer of investigation in respect of CR 142 of 2017 registered with V.P.Road Police Station, Mumbai. Mr. Shaikh, learned APP, on instructions, makes a statement that the subject FIR filed by the petitioner was investigated and, thereafter, charge-sheet was filed against one - Vipul Raut for the offence punishable under Section 324 of the Indian Penal Code, 1860. In the light of this statement, there is no need to transfer and, therefore, we are not inclined to entertain this petition. 3.

Mr. Mhaispurkar, learned counsel for the petitioner, submitted that, apart from the accused - Vipul Raut, there were other persons also Shubhada S Kadam 1/2

12 wp 452.19.doc who have assaulted the petitioner. We are not inclined to accept this submission inasmuch as the FIR filed by the petitioner himself discloses that he was assaulted by the accused named - Vipul Raut only. 4.

In the light of the above, we find no merit in the petition and the same is, accordingly, dismissed.
