IN THE HIGH COURT OF JUDICATURE AT BOMBAY

CIVIL APPELLATE JURISDICTION WRIT PETITION NO.1413 OF 2020 Shivaji Pandurang Chumble ..Petitioner Vs.

State of Maharashtra & Ors.

..Respondents .....

Mr. R. A. Thorat, Senior Advocate a/w. Ketan Joshi, Advocate for the Petitioner.

Mr. Y. D. Patil, AGP for Respondent / State.

Mr. P. N. Joshi, Advocate for Respondent Nos.4 to 13. CORAM : C.V. BHADANG, J.

DATE : 10th FEBRUARY, 2020 P.C.

.

Heard Mr. Thorat, learned Senior counsel for the petitioner and the learned counsel for the respondent Nos.3 to 13. I have also heard learned AGP for the State.

2.

Mr. Thorat, learned Senior counsel for the petitioner states that the only apprehension of the petitioner is that the Managing Committee which is scheduled to meet on 11/2/2020 to consider the impugned letter dated 3/2/2020 by the District Deputy Registrar would be influenced by the observations in the said letter. 3.

I find that the said letter in the final paragraph infact states that the APMC will have to act in accordance with the approved bylaws and the order dated 14/10/2019 passed by this Court in Writ Petition No.10323/2019. Thus, the apprehension on behalf of the petitioner appears to be misplaced. Mr. Thorat, learned Senior Mamta Kale

2/2 24-wp-1413-20 counsel for the petitioner submits that subject to the clarification that Managing Committee will act in accordance with the order dated 14/10/2019 in Writ Petition No.10323/2019, the petitioner is willing to withdraw the petition.

4.

In such circumstances, subject to the above clarification, the petition is disposed of, as withdrawn, with no order as to costs. C.V. BHADANG, J.
