The Appellant has been convicted under Section 354 of IPC r/ w. Section 10 and 12 of the Protection of Children from Sexual Offences Act (POCSO Act). The Appellant has been sentenced to Mamta Kale page 1 of 2

208-apl-144-2018 suffer Rigorous Imprisonment (R.I.) for five years and to pay fine of Rs.25,000/- and in default to undergo R.I. for six months. 3.

The learned counsel for the Appellant states that the Appellant is not desirous of prosecuting the Appeal as the Appellant has served the entire sentence and has been released after serving the sentence. The learned counsel therefore, on instructions, seeks leave to withdraw the Appeal. The record shows that the Appellant has also sent a letter seeking to withdraw the Appeal. 4.

In such circumstances, the Appeal is disposed of, as withdrawn. All pending Criminal Applications are disposed of. C.V. BHADANG, J.
