This revision is already admitted. It is pending since 2003. That is why, the Court has issued a notice to the Applicant as per Order dated 16/01/2024. There is an office note that notice is returned unserved with remark 'The Applicant is dead'. 2.

The Applicant-Ajitbhai was convicted by the Court of the Additional Chief Metropolitan Magistrate for the offence punishable under Section 138 of the Negotiable Instruments Act. Sentence is simple imprisonment for six months and fine of Rs. 10,00,000/-. by SEEMA KSHITIJ YELKAR Date:

Whereas this judgment was confirmed by the Court of the Additional Sessions Judge, Greater Bombay on 16/12/2003. That is why the Applicant has filed this revision application. But now he is no more. His legal representatives have not come forward. 4.

So this Court has no alternative, but to dismiss the revision. Hence the Order:-

ORDER

(i) Revision is dismissed on account of death of the Applicantaccused. (ii) If Respondent-Complainant wants he can take an appropriate steps for execution of the judgment and the concerned court is at liberty to decide it as per the merits. [S. M. MODAK, J.] Seema 2/2
