Heard learned counsel for the Applicant and the learned APP for the Respondent - State.

It appears that the Applicant was initially enlarged on bail by this Court (CORAM : SMT.R.P.SONDURBALDOTA, J.) vide Order dated 12.12.2013 passed in B.A.No.1824 of 2013. However, the Applicant failed to comply with the conditions. It appears that since the Applicant failed to appear before the Court for two years, his bail was cancelled and an NBW was issued and he was taken into custody. The Applicant is in custody since April, 2016.

Learned APP on instructions states that four witnesses have been examined in the said case. He states that three-four witnesses are yet to be examined. He submits that since the trial has commenced, no indulgence ought to be shown to the Applicant.

Considering the fact that the Applicant was absconding for two years and an NBW had to be issued for securing his presence and the fact that the trial has commenced, inasmuch as four witnesses have been examined till date, no indulgence is warranted.

Accordingly, the Application stands rejected. Considering the fact that the trial has already commenced, the trial of the Applicant is expedited.
