It is submitted that Appellant - Krishna is died and no more. Also perused the death certificate. The name of the Appellant is shown as 'SHRIKRISHNA DATTARAM PAWAR'. However, learned counsel of both the parties submitted that Shrikrishna and Krishna Dattaram Pawar was the one and same person. It reveals that Appellant is died on 26/12/2012.
