This is an application under Section 439 of Code of Criminal Procedure for bail.

The applicant came to be arrested in Crime No. 615 of 2021 registered at Bhosari Police Station, District Pune, for the ofences punishable under Sections 376, 376(2)(n), 376(3), 354-D, 313, 316, 324, 506 read with 34 of the Indian Penal Code and Section 3, 4, 5 and 6 of the Protection of Children from Sexual Ofences Act, 2012.

I have perused the statements of the victim. It appears that there was a love afairs between the victim and the present applicant. According to the victim, one day the present applicant took her to secluded place and committed forcible sexual intercourse with her.

Learned counsel for the Applicant, on instructions, submits that the Applicant is still willing to marry the Victim. The Applicant is in jail for more than 11⁄2 years. Considering the overall facts and circumstances, I am inclined to release the applicant on bail. In the result, the following order is passed.
O R D E R
A] Bail Application is allowed.
B] The applicant - Dattu Basappa Pujari, be released on bail in Crime No. 615 of 2021, registered at Bhosari Police Station, District Pune, for the ofences punishable under Sections 376, 376(2)(n), 376(3), 354-D, 313, 316, 324, 506 read with 34 of the Indian Penal Code and Section 3, 4, 5 and 6 of the Protection of Children from Sexual Ofences Act, 2012, on furnishing P.R Bond in the sum of Rs.25,000/- (Rupees Twenty Five Thousand) with one or two sureties in the like amount.
