This is a petition filed under Section 15 of the Arbitration and Conciliation Act, 1996, for appointment of a substitute arbitrator, in the backdrop of the fact that earlier arbitrator has resigned. The parties have agreed upon appointment of Mr. Satish Chander (retired Additional Director General of Military Engineering Services) as the substitute arbitrator. The parties undertake to inform the learned arbitrator about the order passed today, at the earliest.

The learned arbitrator is requested to submit his consent and disclosure statement in terms of Sections 11(8) and 12(1) of the aforesaid Act within four weeks from today to the Registrar (Judicial) of this Court. 4.

The record of the arbitral proceeding is with the respondents and they undertake to provide the same to the substituted arbitrator within four weeks from today.

It is made clear that the arbitral proceedings shall proceed from the stage, where the earlier arbitrator resigned. 6.

All questions are left open for determination by the learned arbitrator. 7.

The petition stands disposed of.
