Mr.Sabrad, learned counsel for the respondent no.1 raised an issue of alternate remedy of the revision application under section 257 of the Maharashtra Land Revenue Code, 1966. Learned counsel appearing for the petitioners on instruction states that his clients would file second revision application under section 257 of the Maharashtra Land Revenue Code, 1966 before the State Government within two weeks from today. Statement is accepted. If any such revision application is filed by the petitioners, a copy thereof shall be served upon the 1st respondent simultaneously.

Writ petition is accordingly dismissed as withdrawn with liberty as prayed. No order as to costs.

It is made clear that this court has not expressed any views on the merits of the matter.

All contentions of both the parties on merits are kept open. 5.

If any such application for condonation of delay is filed by the petitioners, the Revisional Authority shall consider the fact that the petitioners were prosecuting the said writ petition in this court in good faith and with due diligence. The Revisional Authority shall decide the said revision application expeditiously.
