1) The petitioner prayed for direction to respondent no.2 to renew the licence for running the multiplex and exhibit/display motion pictures at the Empress Mall situated at Silvasa. A prayer was made to quash and set aside the order dated 7th September, 2012. By an order dated 16th August, 2012 the Division Bench of this Court in Writ Petition No. 7881 of 2012 filed by the petitioners passed the following order:-

1) "Rule returnable forthwith. Heard finally at the stage of admission by consent of parties.

2) Having regard to the circumstances of the case, the petitioners' application dated 11.11.2011 shall be decided afresh by Respondent No.2 within a period of two weeks from the date of appearance, in view of the No Objection Certificate submitted on 13.7.2012. The petitioners shall appear before the Respondent No.2 on 27.8.2012.

Rule made absolute in the above terms."

2) The Counsel appearing for Respondent No.2 submits accordingly the application of the petitioner was considered and rejected. The said order is not impugned and annexed to this petition. The Counsel further submits that against the said order an appeal is prescribed under Section 12 of the Cinematography Act, 1952.

3) The Counsel appearing for the petitioner submits that alternate remedy as prescribed in law will be resorted to. The statement made is accepted. Keeping all issues open the Writ Petition is disposed of.
