P.C.:- Heard the learned counsel for the Petitioner and the learned APP for the Respondent -State.

We have perused the records of the Petition and annexures therein. We have also perused the records produced by the learned APP. The records disclosed that the Commissioner has recorded the statement of the Petitioner. He has not taken any decision in the matter. The decision seems to have been taken by the Assistant Commissioner, who has communicated the same to the Petitioner. This communication is not in consonance with the directions issued by us in the order dated 9.2.2016 in Criminal Writ Petition No.5022 of 2014. Megha 1/2

The learned APP on instructions of Mr. Suraj Padvi, senior P.I., Sanpada Police Station, who is present in the Court states that present Commissioner of Police, Navi Mumbai will go through the statement of the Petitioner and consider all the material and documents on record and after re-hearing the Petitioner pass appropriate order as early as possible and communicate the same to the Petitioner. The statement is accepted.
