The application is moved for bail as the applicant/accused is facing charges under sections 302, 309 of the Indian Penal Code. One Rupesh @ Ganesh Wadnere gave information to the police on 4.7.2014 at the Lasalgaon police station (Gramin), Nasik, pursuant to which the offence was registered at C.R. No.95 of 2014. It is the case of the prosecution that the applicant/accused and the deceased were having an affair. However, as there were certain disputes, the applicant/accused stabbed her at her residence. The applicant/accused thereafter cut his vein and tried to commit suicide. He was taken in custody on the same day. Hence, this bail application.

The learned Counsel for the applicant has submitted that the applicant is in the prison since last one year and he tried to commit suicide thereafter. He be granted bail.

Learned Prosecutor has opposed the application and he relied on the statements of the witnesses.

Perused the FIR; postmortem reports and the statements of the witnesses. The applicant/accused was caught red handed and there were multiple injuries on the body of the Archana. In my view, it is not a case for bail. Hence, the application is rejected. (MRS.MRIDULA BHATKAR, J.) 2 / 2
