1) Mr. Shetye learned counsel appearing for the applicant submitted that the applicant herein who was accused in Complaint No.317 of 2004 filed by the respondent no.1 in the Court of Judicial Magistrate First Class, Thane, expired on 14.1.2014 at Bagan, District: Zhunzhuna State of Rajasthan. He produced notarised copy of the death certificate of the applicant. Said copy is taken on record and marked X for Identification. In view of the death of the applicant, the Complaint No.317 of 2004 filed against him stands abated. The present application, therefore, becomes infructuous and is disposed of accordingly. (A.S.
