1) This is an application under Section 439 of the Cr.P.C. for bail in CR No.I-333 of 2016 registered with Waliv Police Station,District Vasai under Section 376(d) and 328 of the I.P.C. And under Section 4,6,8,12 of the POCSO Act. 2) The first information report is lodged by the minor victim girl. It is the prosecution case that on 6.7.2016 the applicant along with other co-accused forced the victim girl to drink beer and thereafter committed gang rape on her. After completion of investigation the police have submitted the charge sheet.

3) The first informant in her report has categorically mentioned the name of the applicant and has attributed the role of forcible sexual intercourse by him along with other accused persons. The other evidence available on record not only corroborates the version of the first informant but strengthens her version.

2 /2BA-260-17-44 After taking into consideration the gravity of the offence, this Court is of the view that the applicant does not deserve to be released on bail.

4) Application is accordingly rejected.
