Heard learned counsel for the Applicant. In view of the averments made in the application, a case for restoration of the appeal is made out. Accordingly, we pass following order : (a) The application is allowed in terms of prayer clause (b), subject to condition that Applicant shall supply a copy of appeal for effecting service of notice to the Respondent within a period of three weeks from today. If a copy of appeal is not furnished within the said period, the order of dismissal will stand.
