The Applicant apprehending arrest in connection with the investigation of Crime No.542 of 2021 registered with Lonikand Police Station, District-Pune, under Section 406 read with Section 34 of the Indian Penal Code is seeking anticipatory bail.

The aforesaid Crime is registered on the basis of the complaint lodged by Sagar Ramchandra Isave on 21 October 2021. According to the informant, the Applicant had requested for giving the car of the informant to him for 4 days as the Applicant wanted to travel to Nashik. The car was handed over N.S. to the co-accused Momin Shaikh who had gone to collect the car. The first informant states that the Applicant had promised to return the said car on 6 June 2021 and still had not been returned.

It is submitted by the learned counsel for the Applicant that the car has now been seized by the police and therefore the custodial interrogation of the Applicant is not necessary.

The learned Additional Public Prosecutor on instructions from the Investigating Officer states that the car has been seized under a Panchnamma dated 2 February 2022, copy of which is produced on record which is marked 'x' for identification.

In such circumstances, the following order is passed.

ORDER

(i) In the event of his arrest, in connection with investigation of Crime No.542 of 2021 registered with Lonikand Police Station, District-Pune, the applicant shall be released on bail on executing a P.R. Bond in the sum of Rs.25,000/- with one or two solvent sureties in the like amount.

(ii) The applicant shall co-operate with the investigating agency.

(iii) The Criminal Application is disposed of in the aforesaid terms.
