IN THE HIGH COURT OF JUDICATURE AT BOMBAY

CRIMINAL APPELLATE JURISDICTION CRIMINAL APPLICATION NO.150 OF 2017 IN CRIMINAL APPEAL NO.224 OF 2016 Amar Tanaji Lokhande ...Applicant

Versus

The State of Maharashtra

...Respondent

.....

Mr. Dushyant Pagare for the Applicant.

Mrs. M.M. Deshmukh, APP for the Respondent -State. CORAM : S.C. DHARMADHIKARI AND SMT. ANUJA PRABHUDESSAI, JJ.

DATED: 25th APRIL, 2018.

P.C.:- Having heard the Applicant's advocate, we find that prima facie there are three witnesses, who have deposed that the deceased was seen in the company of the present Applicant before his death. Thus, relying upon the theory of last seen together, the learned Judge has proceeded to convict and sentence the Applicant accused. This is not a stage where we can disbelieve the version of these witnesses and rely upon their one or two statements in the cross examination. 2.

In such circumstances, we find no merit in this application for bail, hence, the application is dismissed. (SMT. ANUJA PRABHUDESSAI, J.) (S.C. DHARMADHIKARI, J.) Megha 1/1
