By this application, the applicant seeks the following prayer:- a) that pending hearing and final disposal of the Cri. Appeal

2/3 No.1243 of 2007 this Hon'ble Court may kindly be pleased to released and return the National Saving Certificates (Exhibit 49 (Colly) & 73 (Colly) standing in the name of Applicant and Original Unit Trust Certificate (Exh.19) in the name of son Vinay B. Kumbhar ;

Learned Additional Public Prosecutor for the Respondent - CBI states that she has no objection if prayer clause (a) is granted. She submits that pursuant to the order dated 15th October, 2007, passed by the Learned Sessions Judge, the applicant has given a banker's cheque, pursuant to which his property was not confiscated by the Court. 4.

In view of the aforesaid, Registrar (Judicial - I), to return the National Saving Certificates (Exhibit 49 (Colly) & 73 (Colly) standing in the name of Applicant and the Original Unit Trust Certificate (Exh.19) in the name of son Vinay B. Kumbhar.

The Application is allowed in the aforesaid terms and is accordingly disposed of.
