The learned counsel for the applicant submits that this Civil Application is made for restoration of Writ Petition No. 281 of 2015, which was dismissed without referring to the Court by order dated 25.11.2016. She further submits that the notice has already been issued to the respondent/original plaintiff, but the respondent has not accepting the said notice. Report was awaited and in between the Writ Petition was dismissed. She further submits that the application for restoration is made within time.

In view of the statement made by the learned counsel for the applicant and the reasons mentioned in the application, I allow this Civil Application in terms of prayer clause (a).
