DATED : 8th JUNE, 2022 P.C:- The applicant was admitted to interim protection by order dated 4/2/2022 in connection with C.R.No.2/2022, invoking Sections 409, 420 r/w Sec.34 of IPC and Sections 3, 7 and 8 of the Essential Commodities Act, 1955. While granting ad-interim protection, the Court has recorded the contents of the FIR, which was based on the allegations that there was misappropriation to the tune of Rs.27,792.92, and the accusation was made on the basis of the survey/inquiry carried out with the ration card holders. 2/2 13 ABA 297-22.doc The contention advanced on behalf of the applicant was also noted in paragraph no.7, to the effect that the FIR do not fix any liability upon the applicant, particularly. The applicant was directed to attend the police station and Mr.Gavand, the learned APP, in the presence of the Investigating Officer who is present in the Court, state that the applicant has co-operated with the investigation and his custody is no more warranted.
In the wake of the aforesaid statement, the order dated 4/2/2022 is made absolute, subject to a further stipulation that the applicants shall continue to render their co-operation to the Investigating Officer in completing the investigation. ( SMT. BHARATI DANGRE, J.) Tilak
