Heard the learned counsel for the parties.

This application is preferred by wife under Section 24 of Code of Civil Procedure, 1908 for transfer of divorce petition filed by the respondent husband bearing H.M.P. No.A 2362 of 2014 under Section 13(1)(ia) of the Hindu Marriage Act in the Family Court at Bandra, Mumbai to the Civil Judge, Senior Division, Satara for hearing and final disposal on its own merits.

The learned counsel for the respondent husband submits that he received instruction from his client that they have no objection if the matter is transferred to Satara for hearing and final disposal on its own merit.

He submits that this Hon'ble Court be pleased Mohite 1/2

8 mca235-15.doc to expedite the hearing of Divorce Petition filed by husband as well as Marriage Petition filed by applicant under section 9 of the Hindu Marriage Act. Hence, by consent of both the parties, following order is passed:

a) Office of the Family Court, Bandra, Mumbai is directed to transfer petition No.A 2362 of 2014 filed by Sandesh Hanmant Mane for divorce under section 13(1)(ia) of the Hindu Marriage Act to the court of Civil Judge, Senior Division, Satara for hearing on its own merits.

b) Civil Judge, Senior Division Satara is directed to hear Divorce Petition filed by Sandesh Hanmant Mane under section 13(1) (ia) of the Hindu Marriage Act, as well as Hindu Marriage Petition No.415 of 2014 filed by Yogita Sandesh Mane under section 9 of the Hindu Marriage Act for restitution of conjugal rights together as early as possible but in any case within one year from the receipt of copy of this order and papers from the Family Court at Bandra.

c) Misc. Civil Application is disposed of accordingly.
