P.C.:- 1) It is the grievance of the Petitioner that, he is an accused in C.R. No.287 of 2012 registered with Wadala TT Police Station, Mumbai and has been arrested on 20th November, 2012. That, after completion of investigation, the said case has been culminated into Sessions Case No.520 of 2014. That, he is in Jail since 20th November, 2012 and his trial has not yet been concluded.

2) Learned APP on instructions from Dy. Superintendent, Mumbai Central Prison, Mumbai submitted that, the trial of the Sessions Case No.520 of 2018 is still pending and the Petitioner is lodged as under-trial prisoner in Mumbai Central Prison.

ssm 2 34-wp443.18.doc 3) In view of the fact that, the Petitioner is an under-trial prisoner for more than last 10 years, we hereby direct the Additional Sessions Judge/ District Judge seized of Sessions Case No.520 of 2014 to conclude the trial of the said case on or before 31st March, 2023, without seeking any extension in that behalf.

4) The Superintendent of Mumbai Central Prison, Mumbai is hereby directed to make necessary arrangement for production of Petitioner on each scheduled date before the trial Court without any excuse of non production of the Petitioner 5) Learned APP is directed to forward a copy of the present Order to the Senior Inspector of Police, Wadala T.T. Police Station, Mumbai for making necessary arrangements of witnesses to be produced on stipulated dates before the Trial Court.

6) Registrar (Judicial-I) is hereby directed to communicate present Order to the Principal Judge, City Civil and Sessions Court, Mumbai by hand delivery.

Petition is allowed in the aforesaid terms.
