The learned counsel for the petitioner submits that the recording of evidence in R.C.S. No. 90/2012 is almost at the verge of completion. In view of this, he seeks liberty to withdraw the petition. Liberty as prayed for is granted in the interest of justice. It is made clear that petition has not been heard on merits. Therefore, all the contentions are kept open.
