Petitioner claimed that he is not partner and not in any way concerned with transaction complained of. He submits that his brother has signed agreement in favour of Respondent No.2 First Informant.

We have perused the statement in support of FIR which mentions participation of Petitioner in the transaction right from day one. Amount of Rs.27,50,000/- has been paid on various dates from 28.04.2012 up to 30.07.2012.

Complainant claims that in December 2012, he learnt that flat agreed to be sold was already sold on 16.08.2012 to one Sunil Shankar Kulkarni.

In view of this averment, we find no case made out at this juncture for intervention in extra ordinary jurisdiction. 5.

Hence, writ petition is rejected.
