Mr.Ramamurthy, learned counsel appearing for the applicant invited my attention to paragraph (7) of the affidavit dated 13th June, 2016 filed by the respondent in which the respondent has agreed to the name of Shri.R.C.Gupta suggested by the applicant in paragraph 10(d) of the arbitration application. Learned counsel tenders statement of disclosure filed by the learned proposed arbitrator in terms of section 11(8) read with section 12(1) of the Arbitration and Conciliation Act, 1996 in the form of an affidavit dated 24th June, 2016. The affidavit filed by the proposed arbitrator is taken on record and is accepted. 2.

By consent of parties Shri.Rameshchandra Gupta, Additional General Manager (Civil) working in the office of Chief Engineer (Building Works) MTNL, Mumbai is appointed as a sole arbitrator. There is no dispute between the parties about existence of the arbitration agreement. Arbitration application is disposed of in the aforesaid terms. No order as to costs. [R.D. DHANUKA, J.]
