This is an application for bail filed by the aforesaid applicant who is arrested in C.R. No.224/2015 registered with Sangli City Police Station, District Sangli for offences under Section 408, 409, 420, 120-B, 201 , 381 r/w.34 of the Indian Penal Code and 7, 13(1)(c)(d) r/w. 13(2) of the Prevention of Corruption Act and Sections 4, 7 and 8 of the Maharashtra Prevention of Malpractice of University Board and Other Specified Examinations Act 1982.

Heard Mr. Patil, learned counsel for the applicant and Mrs. Mulekar, learned APP for the State.

The records prima facie reveal that on 25/11/2015 the Zilla Parishad, Sangli conducted examination for the post of Nurse. The FIR lodged by Mahesh Sambhaji Dhotre, Deputy Education Officer prima facie reveals that one candidate No.70649 in Block No.8 was found copying. It is further alleged that when the supervisor questioned the said candidate, he left the block. It is alleged that at 2.30 p.m. the same candidate was once again found copying. The Junior Supervisor was informed about the same, and after preliminary inquiry, FIR came to be lodged before Sangli City Police Station. The investigation revealed that the present applicant was working as a binder in Zilla Parishad Press, Sangli and that he had circulated the question to Kiran by accepting an amount of Rs.2,00,000/-. 4.
The record reveals that the applicant was arrested on 24/12/2015. The money collected by the applicant has also been recovered. Investigating Officer has also submitted that the
investigation is already completed.

Considering the above facts, in my considered view the applicant is no longer required to be detained in custody. The applicant is a permanent resident of Sangli. There is no possibility of the applicant absconding. Hence the bail application is allowed on the following terms and conditions: i) The applicant be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twentyfive Thousand Only) with one solvent surety in the like amount to the satisfaction of the learned Additional Sessions Judge, Sangli.
ii) The applicant shall not interfere with the complainant or any other witnesses in any manner. iii) The applicant shall not leave Sangli District till the filing of the chargesheet without prior permission of the learned Additional Sessions Judge, Sangli. (ANUJA PRABHUDESSAI, J.)
