The parties have resolved the dispute. The Petitioner is the nephew of Respondent No.2/complainant's husband. 2.

The First Information Report was registered on 30th June, by SUNNY ANKUSHRAO THOTE Date:

2024.03.14 10:29:27 +0530 SUNNY ANKUSHRAO THOTE 2023 with Wada Police Station, Dist. Palghar for offences under Sections 354-A, 354-D, 506 and 507 of Indian Penal Code (for short 'IPC').

It is submitted that since the Petitioner and Respondent No.2 are the close relative, the family members have arrived at the amicable settlement and hence the complainant has no objection

for quashing the charge-sheet.

The Respondent No.2 is present in the Court. She has expressed her consent for quashing the impugned proceedings. She had filed affidavit. She is represented by Advocate. 5.

In the Affidavit it is stated that the Petitioner is the nephew of Respondent No.2-husband. Therefore, being member of family, the parties on their own will and accord agreed t bury the hatchet to amicably resolve the dispute and lead life peacefully without interference of each other. They have reached an understanding where both have agreed to settle the matter and quash the proceedings by mutual consent. The complainant has no grievance and/or complaints against the Petitioner. 6.

The Petitioner is also present in the Court. It is submitted that the Petitioner would not cause any harassment or trouble of any nature to Respondent No.2 in future course of time. 7.

Considering the aforesaid circumstances, the impugned proceedings can be quashed.

ORDER

i.

Criminal Writ Petition No.762 of 2024 is allowed; ii.

The proceedings in R.C.C. No.166 of 2023 pending

before the Court of learned J.M.F.C. Wada, Dist. Palghar arising out of FIR dated 30th June, 2023 with Wada Police Station, Dist. Palghar vide C.R. No.253 of 2023 are quashed and set aside.

iii.

The Petitioner shall pay cost of Rs.25,000/- to Advocates Association of Western India Generation Next within a period of three weeks from today. The Account details are as under: Account Name : Advocates Association of Western India Generation Next A/c No.
