1) Learned APP, upon instructions from A.S.I. Nalawade submits that in the present case, trial against accused has commenced. The substantive evidence of the complainant has been recorded. In view of this, applicant does not deserve bail after trial has commenced as Hon'ble Co-ordinate Bench of Justice Abhay M. Thipsay had considered the subsequent bail application on the ground that trial had not concluded within the stipulated period. Hence, present applicant cannot claim parity.

2) Hence, application stands dismissed.
