This is an application for pre-arrest bail. The applicant is apprehending arrest in an offence which is likely to be registered by his wife namely Smt.Ruby Bhaskarananda Shah under section 498-A, 406, 306 read with section 34 of the Indian Penal Code.

The applicant has stated that the trial Court has rejected his application on the ground that the crime is not yet registered against him. The learned APP on instructions from the Police Officer attached to Saki Naka Police Station submitted that said Smt.Ruby Shah has not yet lodged the First N.S. Kamble page 1 of 2

905-aba-194-2016 Information Report with the said Police Station. 3.

In view of the above, the police from Saki Naka Police Station, are hereby directed to give a notice of 48 hours in case of arrest, in the event Smt.Ruby Shah lodges First Information Report under section 498A, 406 read with 34 of the Indian Penal Code against applicant. The application is disposed of in the aforesaid terms.
