This is an application for suspension of substantive sentence imposed on the applicant and releasing him on bail during pendency of the appeal filed by him.

Heard Shri.Jadhav, the learned appointed Advocate for the applicant/accused. He submitted that the instant application is rendered infructuous with passage of time as seen from the report of the Superintendent, Central Prison, Kolhapur. (14)APPANo.15682014 It is seen that unfortunately this appeal could not be taken up for final hearing which resulted in the applicant undergoing the entire substantive sentence imposed on him. This fact is reported by the Superintendent, Central Prison, Kolhapur vide letter dated February 2018. The application is, therefore, disposed of.

The appeal be, therefore, placed for final hearing in due course.
