Both the Courts below have recorded the concurrent finding of fact that the suit is barred by the principle of res judicata, which is a mixed question of law and fact. There is no substantial question of law which arises for consideration. The second appeal is dismissed.

In view of dismissal of the Second Appeal, Civil Application No.1933 of 2012 does not survive and it accordingly stands disposed of.
