By a detailed order dated 4 February 2022, interim protection was granted to the Applicant. Prima facie, it appears that Vijay Chavan who is said to be the main accused had forged the allotment letters / possession receipts. It appears that the Applicant had paid Rs.85,000/- to Vijay Chance by a Bank entries. Normally a person would not part with money in favour of the co-accused knowing that the documents of allotment and possession are forged and fabricated.

The learned counsel for the Applicant submitted that the Applicant is in fact victim of the entire transaction in which several such persons were duped by Vijay Chavan.

The Applicant has reported to the Investigating Officer in pursuance of the interim order and has cooperated with the investigation and has produced all the necessary documents and has furnished his specimen signature.

In that view of the matter, I do not find that the custodial interrogation of the Applicant is warranted. Considering the over all circumstances, the Criminal Application is disposed of in terms of order dated 4 February 2022, which is hereby made absolute. C.V. BHADANG, J.
