Heard learned Counsel for the respective parties. 2.

We finds that the period of the tender has already expired. In the circumstances, with a liberty to the petitioner to submit a representation in regard to refund of the amount of Rs. 1,94,08,667/- deposited by the petitioner, with accrued interest, we pass the following order.

a) The petitioner to submit an appropriate representation along pps

26 wp 1438-16.doc with the supporting documents, before the respondent within two weeks.

b) On receipt of the representation, the Competent Authority of the respondents shall consider the same and take appropriate decision on it in accordance with law, as expeditiously as possible, but in any case, not later than three months from the date of receipt of such representation.

c) Needless to state that, if the petitioner is found entitled for refund of the amount with interest, the same shall also be paid to the petitioner expeditiously.
