The learned counsel for the Applicant submits that by this First Appeal, they are challenging only quantum. Therefore, it is not necessary to take appropriate steps against Respondent nos.3 and 4. Statement is accepted.

By this Civil Application, Applicant is seeking condonation of 63 days delay in filing First Appeal challenging the judgment and award dated 15.7.2014 passed by MACT Gadhinglaj in MACP No.5 of 2013.

Considering the submissions made by the learned counsel for the Applicant and the averments made in Civil Application, I am satisfied that the Applicant has made out a case for allowing the Civil Application. Hence, following order is passed:

Delay in filing First Appeal is condoned.

b.

Names of Respondent no.3 and 4 be deleted from cause title of First Appeal as well as pending Civil Applications.

c.

Civil Application stands disposed of accordingly. No order as to costs.
