The learned counsel for the petitioner seeks liberty to withdraw the present petition, as this Court is of the opinion that it is not maintainable since the counsel is challenging the order passed by the District and Sessions Judge, Vasai dated 4th November 2017 in an appeal wherein, the appeal filed by the present petitioner was partly allowed.

Liberty as prayed for is granted, in the interest of justice with further liberty to take appropriate proceedings before the appropriate forum.
