Applicant is seeking regular bail in Crime No. 709/2018 registered with Sinhgad Road Police Station, Pune for offence punishable under sections 306, 506 r/w 34 of the Indian Penal Code. Applicant was arrested on 04/01/2019.

The prosecution story is complainant Radhika alleged that her husband had taken hand loan from other co-accused and since inspite of the fact that same was repaid, the applicant threatened

2 906.325.19 ba.doc Dnyaneshwar, husband of the complainant resulting into said Dnyaneshwar committing suicide leaving behind suicide note naming applicant as one of the co-accused responsible for abetting the offence of suicide.

The suicide note is already seized from the custody of deceased on the date of incident. The applicant is subjected to custodial interrogation and nothing incriminating was recovered from the applicant. There are no antecedents. That being so, applicant deserves to be released on bail. Hence, following order: (A) Applicant be released on bail on furnishing P.R. bond in the sum of Rs. 25,000/- with one or more sureties in the like amount.

(B) Applicant shall not influence witnesses or tamper with evidence.

Application stands disposed of.
