With consent, the impugned order dated 15/01/2021 passed by District Judge-1, Sindhudurg-Oros in Civil Miscellaneous Application No.34/2020 is set-aside. Leave is granted to withdraw the Civil Miscellaneous Application No.34/2020 on the file of District Judge, Sindhudurg-Oros with liberty to file fresh Application under Section 9(4) of Hindu Adoption and Maintenance Act, 1956. It is made clear that this Court has not gone into the merits of the matter and the said Application, if filed, shall be decided on its own merits without being influenced by the observations made in the order dated 15/01/2021. 2.
