CRIMINAL APPELLATE JURISDICTION CRIMINAL WRIT PETITION NO.436 OF 2017 Shri Vijay Mallari Kharabi & Ors.

] ... Petitioners

Versus

State of Maharashtra.

] ... Respondent Mr. Vilas B. Tapkir for Petitioners.

Dr. F. R. Shaikh, Addl. P. P. for State.

CORAM :- R. M. SAVANT & SARANG V. KOTWAL, JJ.

DATE :- 05 MARCH, 2018 P. C. :- Having regard to Section 152 of the Indian Electricity Act, 2003 (for short, 'the said Act'), we do not deem it appropriate to interdict in our writ jurisdiction, for quashing of the FIR in question which has been registered under Section 135 of the said Act. Hence, the Writ Petition stands dismissed. However, it will be open for the Petitioner to file an application under Section 152 of the said Act for compounding of the offence. If any such application is filed, it is needless to state that the same would be tried on its own merits and in accordance with law.
