Learned advocate for respondent Nos.1 to 5 states that the respondents have no objection for remand back the matter to the Tehsildar for decision afresh in accordance with law. Hence, the impugned order passed by the Tehsildar confirmed by the SubDivisional Officer are quashed and set aside. 2.

The proceeding is remanded back to the Tehsildar, Daund for decision afresh.

All contentions raised by both the parties are kept expressly open to be agitated before the Tehsildar in accordance with law. 4.

The Tehsildar shall decide the proceeding within four

Parties shall appear before the Tehsildar on 26th February 2024 at 11:00 a.m.

Respondent No.1 to 5 are permitted to amend their original application to add necessary parties.

The writ petition stands disposed of in above terms. No costs.
