In crime No.13/2019 for offence punishable under sections 420, 406, 468, 470 and 471 of the Indian Penal Code registered with Ichalkaranji police station, District Kolhapur, the applicant is seeking regular bail after his arrest on January 15, 2019.

The applicant was subjected to custodial interrogation and nothing incriminating was recovered from him. 4.

The prosecution case is, accused No.1 hired vehicle of

2 907) ba331-19.doc the complainant and sold it to third person. The documents of the vehicle were prepared / tampered by using the Cyber Cafe of the applicant.

The applicant appears to have taken precaution while permitting co-accused to use his Cyber Cafe by collecting his identity and other details.

There is no material to infer conspiracy on the part of the applicant as the same is not invoked in the crime in question. In absence of any criminal antecedents, the applicant is entitled to be enlarged on bail. Hence the order :- i) The applicant be released on bail in Crime No.13/2019 for offence punishable under sections 420, 406, 468, 470 and 471 of the Indian Penal Code registered with Ichalkaranji police station, District Kolhapur, upon furnishing P.R.bond of Rs.25,000/- with one or more sureties in the like amount; ii) The applicant shall not influence the prosecution witnesses or tamper with the evidence;

iii) The application stands disposed of accordingly. (NITIN W. SAMBRE, J.)
