TUESDAY, 14th MARCH, 2017 P.C. :

Petition is filed seeking direction to the respondent Nos. 1 to 4 to file charge-sheet against Shaan Education Trust, Ambernath and its trustees in pursuance to C.R. No. 168 of 2013 registered with the Ambernath Police Station.

Learned A.P.P states that after completion of the investigation in the said C.R, charge-sheet is filed against 7 accused. He further submits that the accused Nos. 8, 9, 10 and 11 are absconding and therefore chargesheet could not be filed against them. However, permission under Section SQ Pathan 1/2
wp.439.17.42.doc 173 (8) of the Code of Criminal Procedure, for further investigation is sought. He also states that once wanted accused are arrested, further investigation would be completed and appropriate report would be filed. The said statement is accepted. In support of his submission, he tenders report dated 14th March, 2017 of Sr. Inspector of Police, Ambernath Police Station. The same is taken on record.

In the light of the statement made hereinabove, the learned Counsel for the petitioner fairly states that grievance of the petitioner made in the petition does not survive.

Petition is accordingly disposed of.
