After hearing for sometime, a motion is made by the learned counsel for the petitioner-accused to withdraw this petition with liberty to canvass the issue qua denial of an opportunity of hearing to properly defend the case of the accused by refusing to direct production of the documents which were seized by the Central Excise Department during an inquiry as reflected in the Panchanama dated 29/01/1996.

2 907.454.18 wp It is expected of the learned Trial Court to deal with the said issue, if raised at the time of final hearing. With above observations, petition stands disposed of as withdrawn.
