IN THE HIGH COURT OF JUDICATURE AT BOMBAY

CIVIL APPELLATE JURISDICTION by URMILA PRAMOD INGALE Date: 2022.11.18 17:57:58 +0530 URMILA PRAMOD INGALE WRIT PETITION NO. 1010 OF 2020 Sou. Urmila Sunil Patil ..Petitioner vs.

Shri Sunil Kisan Patil ..Respondent Mr. V.R. Gaikwad, for petitioner.

Ms. Rati S. Sinhasane, for respondent.

CORAM : M. S. KARNIK, J.

DATE : NOVEMBER 18, 2022 P.C. :

1.

On the last occasion, I had indicated to the learned counsel for the respondent-husband that the maintenance awarded by the trial Court is too meagre considering the overall circumstances of the case and the fact that the respondent is presently working in the Defence Ministry as an Engineer. Learned counsel for the respondent then have taken time to obtain instructions if a voluntarily statement can be made by the respondent to pay her higher maintenance amount.

2.

In all fairness, learned counsel for the respondent, on the instructions of the respondent, submitted that the respondent is willing to pay interim maintenance of Rs.20,000/- per month from 01/01/2022. It is the contention of the learned counsel for the respondent that the interim maintenance in terms of order passed by the trial Court is already paid. It is made clear that the amount of Rs.20,000/- per month to be paid from 01/01/2022 and arrears thereon will be paid notwithstanding that the maintenance in terms of the order dated 06/06/2018 has already been paid to which the respondent agrees. 3.

The interim maintenance in terms of clause (1) of the operative part of the order dated 06/06/2018 is accordingly enhanced to Rs.20,000/- per month payable with effect from 01/01/2022. This is purely an interim arrangement and the main petition will obviously be decided on its own merits in accordance with law without being influenced by passing of such interim maintenance.

4.

The trial Court to decide the maintenance application without being influenced by the observations made in this

order.

5.

The arrears to be paid within a period of six weeks from today. Petition is disposed with no order as to costs. (M. S. KARNIK, J.)
