Heard learned Advocate Shri Dhaygude for the Applicant.

As per Orders dated 08/10/2021 and 07/12/2021, there was condition imposed not to reside the jurisdiction of the Phaltan Rural Police Station. It was imposed while granting him bail. In view of the health condition, there is a prayer for relaxation of this condition. Certain medical papers from Yashwant Diagnostic Center and Yashwant hospital, Satara are annexed. As against relaxation, the Applicant is ready to give attendance to the Police Station as directed by this Court in the Order dated 24/11/2022 passed in bail application nos. 1726 of 2022 and 1730 of 2022 of the co-accused.

There is no grievance of the misuse of the condition imposed while granting bail.

Considering all above circumstances, the condition no. 2 needs to be cancelled and instead of that attendance can be given. Hence following Order :-

ORDER

(i) Interim Application is allowed.

(ii) The condition No. 9 (ii) in the order dated 07/12/2021 is relaxed. Instead of that Applicant to give attendance to the Phaltan Rural Police Station, Satara on every first Monday in two months from 11 a.m. to 02.00 p.m. for one year.
