Heard. This application is for condonation of 14 days delay in preferring the appeal challenging the judgment and award dated 31/10/2013 passed by the ESI Court, Mumbai in application (ESI) No.30/2004.

The learned counsel for the respondent vehemently opposed the civil application. He submits that the applicant has not made out a case for allowing the civil application. There is no substance in the civil application. Hence, the civil application be dismissed with costs.

Considering the submissions made by the learned counsel for the applicant and the averments made in the civil application, I am of the opinion that the applicant has made out a case for allowing the civil application.

Hence, following order is passed:

(a) Civil application is allowed in terms of prayer clause (a) which reads thus:

(a) That this Hon'ble Court may be pleased to condone the delay of 14 days in filing the appeal.

(b) Civil application stands disposed off accordingly.
