Heard the learned counsel for the applicant and the learned APP for the State.

The applicant is a husband of the complainant, who had lodged the complaint in Khadakpada Police Station on 12/10/2021 stating therein that her marriage with the applicant was solemnized on 07/06/2020. The longish FIR contains various allegations against the husband and her inlaws, including her sister-in-law and brother-in-law. The FIR would reveal that the applicant is alleged to have been carrying an illicit relationship with one woman and this is alleged to be a harassment.

In the light of the allegations levelled against the accused persons when they approached the Sessions Court, barring the present applicant, all other accused are released on bail in the event of their arrest.
Perusal of the order would reveal that as far as the husband is concerned, since he was also alleged to have committed the offence under Section 313 of the IPC, he was held not entitled for the anticipatory bail. 4.
The FIR alleges that the present applicant alongwith his sister, forced the complainant to consume i-pill and she was locked in the house, resulting into miscarriage in the house itself. The allegations surely are serious, but do not warrant custodial interrogation. Subject to the stipulation that the applicant shall render co-operation to the investigating agency, he is entitled to be released on bail in the event of his arrest. : ORDER :
(a) The application is allowed.
(b) In the event of arrest in C.R.No.I-302 of 2021 registered with Khadakpada Police Station, applicantPrashant Laxman Ghoderao shall be released on bail on furnishing P.R. bond to the extent of Rs.25,000/- with one or two sureties of the like amount.
(c) The applicant shall report to the concerned police station on Monday and Tuesday between 10.00 a.m. to 2.00 p.m. for a period of two weeks and, thereafter, as and when called for.
3/3 5 ABA-320-22.doc (d)The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with facts of case so as to dissuade him from disclosing the facts to Court or any Police Offcer and shall not tamper with the prosecution evidence.
